Privacy Policy

Fusion Digital is committed to respecting your privacy, and ensuring the safety of your information. This privacy policy is intended to convey to you what information we may collect about you, how we use it, and who we may disclose it to.

Information we collect

We collect two types of information, information about you personally, and anonymous information about your computer and connection.

Information about you is not gathered via any automated means, and must be specifically volunteered via such means as a contact form, or a purchase.

Anonymous information is also collected by our web server or a third party site traffic monitoring service which we may opt to use, and is used to assist in technical administration of this website, or to provide more relevant content throughout this website. Such information includes:

  1. The IP number and location of site visitors
  2. The date, time and duration of visits
  3. The number and pattern of pages viewed
  4. Technical information about the browser and internet connection
  5. Auditing logs of all site activity

This information is not ordinarily used to identify a specific individual, however in extraordinary cases we may use it in connection with you to attempt to diagnose and resolve technical issues. If we are able, we will attempt to contact you first to obtain your authorisation to do so.

Fusion Digital applications also contact version checking services operated by Fusion Digital. These communications will be limited to the purpose of checking that the installed version of the application is up to date, and certain information must be sent to do so. This information is limited to a code identifying the application name, and the installed version. Some applications may also send your unique license code for the purposes of determining eligibility for access to upgrades.

Information Disclosure

Fusion Digital takes your privacy very seriously. Your information is not disclosed for any purposes not explicitly connected with our providing products or services to you, or where required by law.

Some exceptions occur, and these are listed explicily here;

  1. Credit card purchases are securely processed by our bank's gateway provider, Direct Payment Solutions.  DPS' privacy policy can be reviewed at http://www.paymentexpress.com/about/about_paymentexpress/privacy_policy.html
  2. Purchases of our products will be verified against a third party database provided by MaxMind, Inc for the purposes of fraud detection and prevention. MaxMind's privacy policy can be viewed at http://www.maxmind.com/en/privacy_policy
  3. In the event of a fraudulent transaction or unpaid debt, details of such transaction may be shared with a fraud recording service and/or debt collection agency of our choosing. Any such data sharing will be conducted in accordance with New Zealand privacy laws.
  4. Purchases of iPhone OS versions of our software are processed by Apple, Inc or an affiliate.  Apple's privacy policy can be reviewed at http://www.apple.com/legal/privacy/.
  5. Purchases of Windows Phone versions of our software are processed by Microsoft Corporation or an affiliate.  Microsoft's privacy policy can be reviewed at http://www.windowsphone.com/en-us/legal/wp8/windows-phone-privacy-statement.
  6. Registrations on our forum may be verified against a third party database in order to verify that such registrations are not for the purpose of unsolicited commercial postings. Such verification will be performed by Invision Power Services, Inc, whose privacy policy can be reviewed at http://www.invisionpower.com/legal/privacy.php.

We may also share aggregate statistical data with third parties. Such information cannot be identified with any individual and will not include contact information.

Cookies

Cookies are small text files stored on your hard drive which allow information to persist across browser sessions, or small pieces of information in your computer memory which allow information to persist only until such time as the browser is closed.

We use persistent cookies to provide personalised features, and to track traffic patterns across our website. This tracking is not associated with you as an individual, and is used solely to identify popular areas and areas in which we may need to make improvements in our site. Certain areas, such as the forum, can use persistent cookies in order to maintain login sessions and preferences at your direction. You agree to the placement of such cookies by using such functions.

Information you provide to us

We may provide online forms on our sites which will request specific personal information from you including, but not limited to, name, postal address, company name, email address, phone number or details about an existing relationship with us. Where confidential information is requested, we use industry standard SSL encryption to ensure your information is secure. Such information is used only for the purpose for which it was requested, and is discarded where practical when it is no longer required.

From time to time, we may invite you to provide additional information in connection with promotions, competitions or surveys, Such information will be used in accordance with this privacy policy.

When we contact you

We may contact you using the email address, postal address or phone number you provided to us to let you know about changes and upgrades to products you purchased or services you subscribed to. Such contacts will be limited to issues requiring your urgent attention only.

Additionally, we may contact you via your registered email address in connection with surveys, promotional activites special offers, or other information about products and services you subscribe to. Such contact is optional, and you can opt our by contacting our support department via the forms located at http://support.fusiondigital.co.nz/.

Data security

Your information is held securely on servers under the control of Fusion Digital and its parent, Chain Reaction Technology Corporation. Servers are located in a secure data-centre, and access is restricted by the use of secure login passwords and other security procedures.

Credit card details you provide as part of a purchase are provided to Direct Payment Solutions Limited, or alternative payment processing providers at our discretion, and handled in accordance with the Payment Card Industry Data Security Standards. Fusion Digital Entertainment Limited does not see your credit card information.

Fusion Digital servers are also accessible to support engineers employed by our datacenter providers (Softlayer Technologies, Inc and Dacentec, Inc), who provide server hosting services to Fusion Digital Entertainment Limited. Datacenter engineers do not access Fusion Digital servers except at the express direction of Fusion Digital for the purpose of providing support for the maintenance and administration of such servers.

Access to your information

Fusion Digital, full legal name Fusion Digital Entertainment Limited, is a registered company in New Zealand. As a New Zealand company, we hold your information in accordance with the Privacy Act 1993.

At any time, you have the right to access the information we hold about you, and to make corrections. Please note that we will require you to provide identification in order to validate your identity before we provide any personal information.
